Dear Sir/Mam,
I am Ravi arora, currently working with pvt life Insurance Co. and I am a Confirmed Employee of the company. Last month i got injured and Still I am on medical leave. I already takes around 6 weeks medical Leaves and I Confirmed from Hr that I can Avail my Total Leaves as medical Leaves. Still I am not Comfortable to Join and 30 Carry Forward Leaves are still pending. My employer force me to join Immidiately and called me many times but still I am not ok due to my Injury. Plz suggest in this case what should I do. I also marked the mail with Doctor Medical certificates and Doctor Prescription.
Is there, my Employer can takes any action against me??
Plz Suggest all consequensis in this case.

From what you mentioned, obviously, your company HR DOES NOT believe you--that your request for extension of Medical Leave is necessary.
You have not mentioned the reason for your medical leave--when you wish the members of this Forum to give suggestions, unless you give details, you will only get half-baked suggestions based on your incomplete inputs. When you mention 'injury', it can mean anything. There could be injuries that would take months to heal & there would be injuries that heal in a couple of weeks, if not a few days.
Coming to the Medical Certificates that you forwarded to your HR, pl understand that beyond a point, especially in the age we live in, such documents loose their sanctity unless corroborated/strengthened by additional evidence.
Did you check with your HR the reason(s) why you are not being given extension of the Medical Leave?
Pl give the FULL & COMPLETE details of your medical condition so that the members can give you realistic & accurate suggestions.

But, prima facie, I think you are in a no-win situation.
Given your medical situation [this could take quite some time to heal, since Spinal injuries don't heal fast & most often need bed-rest continuously], my suggestion is to quit the job & FOCUS ON YOUR HEALING.
What your Company seems to be doing is to avoid paying salary for a long duration--obviously they too would know that this won't be fast--COULD take even months. By asking you to rejoin, they are IN FACT forcing you to resign.
Once you are ready again, you can then hunt for a new job. Also, suggest speak to your HR & keep your options open to rejoin again after your recovery.
I know this IS A TOUGH DECISION you will need to take. But suggest see it realistically--after all your health is more important AT THIS POINT OF TIME.

I understand your situation. Here the one thing that you can do is to take up this issue through your immediate Boss who can represent to the higher ups through your HR. In this scenareo an emplyee taking long leave on whatever ground may definetely derail the activities to certain extent that also in private insurance companies where the competition is tough to very tough. Your case seems to be genuine and the HR people also can be reasonably understanding but if they also get some pressure from their higher ups, they are helpless. So please talk to your boss, make him understand the situation and proceed. Anyway health is important and currently you concentrate on it. Anything worst happen on your professional career can be taken care of once you are back on your heals.

I agree with the views expressed by all seniors, please do visit the office once and speak to your superiors and HR too, meeting in person, is always better and they might reconsider their stance on your joining, and if they do not, your health is more important as expressed by TJ
Just adding a case that is with me currently.
One of our employees had been detected of multiple blockages in heart, currently undergoing treatment for the same. The said employee is on medical leave, since 2 months, but he has left no stone unturned, every time he can he manages to come for sometime during afternoons, and overseas his junior and clears his doubts on the job. ( He is covered under ESIC, hence the delay in the procedures, but last week, he got last of the stents fitted, and may join full time soon)
Although in this case he is a very old employee, and enjoys good equity with the management.
