Dear All,
I have submitted my resignation as per policy of company. I have served my one month notice period be till now company is not releving me from my services and i have to join new organization. my current company is forcing me to continue my services by one month. if I continue with my current company i have to loose new offer. Requesting you to please guide me.

How did you submit your resignation? Was the letter acknowledged? Have you any proof that they got your resignation letter?
Also, kindly give as much information about how long you have worked for the company, in what capacity, etc.

Dear Pravin,
Your resignation needs to be accepted by the management of your company for your releiving. You have explained that you have resigned and served one month notice. Below queries are still unanswered :
1.) What was the mode of your resignation?
2.) Whether the company has acknowledged and accepted your resignation or not?
3.) Do you have a copy of your resignation (duly signed by HR a token of receipt ; if the resignation was not submitted through e-mail)
4.) What is the required notice period as per the appointment letter?
5.) What is your designation in that organization and what type of assignment you were taking care of?
Kindly reply the above query, so that members can provide a better suggestion.

1.) What was the mode of your resignation?
I had sent my resignation through Mail. I got reply form my MD after 20 days states that we will discus the matter one to one. They have not acknowledged or accepted my resignation ( I have sent reminder to GM HR for has not responded. as per my appointment letter I have to give one month notice period & my designation is executive A & R.

Dear Pravin,
Reply from your MD is itself the acknowledgement of your resignation. Talk to your MD & HR first and explain your situation. If the matter is not being resolved then send a mail to your managment in reply to MD's mail mentioning that you have resigned from your services as per company policy and followed proper notice period as mentioned in clause no. xx in the appointment letter. You are legally eligible for your all the employment benefits and proper relieving. Hope the company will accept your resignation.
If they are creating some problem in your relieving, you can explain your situation to your new employer on later stage. Keep the printouts of all communication regarding your resignation for proof copy if need further,

Dear Pravin,
Having tendered your resignation and the MD insisting you to serve one month more, please have a one to one frank talk with him stating that you have resigned from the company as per the rules and that you wont like to run away without a proper release. In case he has some specific problem, say that you are prepared to abide by his desire provided he agrees to write to your prospective employer about the date of your release and til then they should keep your offer of appointment valid. should he agree, please write to your prospective employer through the present one about your date of release and request them to keep your offer open til then. I am sure your problem shall be sorted out.
