You can meet the company management & explain the same. Even after they are not paying you shall tell them as you will be in a position to meet the labour insector

Q 1 Are you sure that your employer is not registered with PF?
Q 2.Any salary slip / certificate is with you as proof of Deduction on Account P.F. ?
Q 3. In your original appointment letter/ offer of employement, the clause of PF is incorported ?.
If answer to Q 1 is No: and Q2 & Q3 are Yes.
Then this is a regular cheating case. Under RTI ask the Employer Code from concerned RPFC. Then wait till answer to RTI Query from RPFC. If your employer is not registered with RPFC then I do not think they will be support you immediately. But keep register one complaint with the said RPFC and issue notice from your lawer under IPC 420. This action, may help you to get the bad debts.

In my view , if the Er. is covered / coverable under the EPF Act , then Er will not refund the amount as sooner or later , he has to deposit the same with PF office. In such a situation, it is advisable to take up the matter with the RPFC only who will recover the entire default amount first along with Damages and upto date interest and then settle the claims.
In case the Company is not coverable under the Act but has deducted the PF, the Er. is bound to refund and in case of denial, file a case in the local court.
