Dear All,

Suppose a person was under ESI slab in the previous month; say his salary was 14500, and this month he got an increment of Rs. 1000, making his salary Rs. 15500. What about his ESI contribution? Do we need to deduct the contribution from his salary, or can we stop deducting the contribution straight away? Can you please provide me with a solution for this?

At last, I myself found the solution...! If the remuneration of a person exceeds the ceiling of the ESI, the corresponding contribution has to be deducted from the employee's salary for that contributory period. Thereafter, it can be stopped.

Sir, please see proviso to Section 2(9) of the ESI Act, 1948, which lays down that if the wages of any employee exceed (excluding the amount of overtime) during any month after the beginning of the contribution period, then the said employee "shall continue to be an employee until the end of that period".
