I am working in retail industry. we have 10 showrooms in Gujarat, UP, Delhi, Maharashtra & AP. I want to know that is there any procedure for getting 365 days opening permission?. If there is any format please share with us.

Hi, you can contact local labour department.. 365 days opening permission under Shops & Establishment Act... you can also get format and form from shops & establishment act......

Kuldeep ji rightly answered your query. Granting the permission to keep a shop / Factory working on 24x7 is with in the jurisdiction of appropriate Govt. Each state has a separate procedure, forms and formats of it's own. You are advised to approach respective authority in every location.

Here is the guidance from my son who is VP in an FMCG company and himself controls a number of showrooms of the company:
- For 365 days showroom opening apply for permission to work on all days to the Shops and Establishments department in each City. Only the Shops and Establishments department can waive the mandatory weekly off for all commercial establishments
- A letter needs to be submitted stating that the concerned shop will give weekly off, on rotation, to all members of the shop.
- A register, in the prescribed format, will have to be maintained to show attendance and weekly off to each member of the store in rotation.
The procedure is quite straight forward but has to be done separately for stores in each city. Additionally there are rules which prevent for working beyond 8 pm or before 6 am.

You can open 365 days you need to do that every employees must get a weekly off u can allocate alternate days weekly offs to each employee rest u can apply for national & festival holidays for permission to open as due to nature of your business because nation & festival holidays are must in every state under shops & establishment they can vary state to state as far as weekly offs are they compulsory
