Hi Seniors, on employee has left the job in nov-12 and his a/c was settled, and his all paid leaves and gratuity were exempted u/s sec 10 of i.tax act. After two month later on Jan-13(same financial yr) he has re-joined the same establishment. Is the gratuity and leave amount which was exempted will be added back to his income and recalculate the tax or it can be ignored.

Dear Vikram,
Since earlier settlement is full n f inal n the subsequent one is re-employment, I think the amount received by way of gratuity cannot be treated as income as there is explicit exemption u/s 10
