i knew the rule for providing NH is an employee should work continuously before and after the NH. i heard this is an old rule but i dont know the current rule for NH. now am in tamil nadu zone C. Please describe me the correct rule for this...

For National holidays employees need not to work on previous or next day of holiday. They must be on role with some present days. If that employee continuously absent without any information then he is not eligible.

Hi Naveen,
Would like to quote the clause stated about the availing of paid Holiday for an employee...
"Provided that no such employee shall be entitled to be paid any wages for any of the holidays allowed under section 3 other than [26th January, the 1st May, the 15th August and the 2nd October] unless he has been in the service under the employer for a total period of 30 days, within a continuous period of ninety days immediately preceding such holiday"
Note: Section 3 is talking about the Grant of National and Festival Holidays.

Dear Pragna, Its good for your responce but the other question is, How to calculate the salary/Wages for NH, it is one day extra or two days extra if employee works on NH

Hi Syed,
Would like to quote the section for the same...
Where an employee works on any holiday allowed under section 3 (i.e on N & F holidays allowed), he shall, at his option, be entitled to ----
(i) twice the wages; or
(ii) wages for such day and to avail himself of a substituted holiday with wages [on one of the three days immediately before or after the day on which he so works]

My company is in retailing business, they have showrooms at several locations, the management wants to keep the show-rooms some of them also located in 'malls'. If you want to keep open your retail shops on National Holidays and engage your employees, you can do that. But there is a statutory procedure & has to be followed, strictly, as far as Tamil Nadu concerned...
There is a form called "Form V-A" - employees working list on National Holidays has to be sent to the respective authorities, prior to the holiday and double the wages or leave with wages on some other day for working employees have to be given.

National and Festival Holidays are governed by independent State Act and provisons are made in the enactment on, number of holidays as N &F holidays, rate of payment ,availment and other procedures. Please refer respective state Act on this.
