I have a some doubts in PF and ESI. Can any one give the correct solution for me.
1. If a company decided to close the PF contribution for above and below Rs.6500 (Basic +DA) employees, what is the procedure?.
2. Is it possible to stop ESI for below Rs.15000 salaried person, If they are in training period.

Hi Boopathy, 1. You can stop the PF contribution once the employee becomes PF member even when his salary goes more than 6500/- 2. Even Trainee are also eligible for ESIC. Regards, Vinod Bidwaik

Dear Boopathy,
You cant stop any legal benefits once given to the employees. Yes, For the new employees who has to join the organization and have their basic salary above 6500, they can fill Form 11 and no need to give them the PF benefits then.
For ESIC, you can't stop ESIC benefits if the employee has the salary of 15000.

You give wrong advice, If employer deduct the PF of any his/her employee can't stop the PF deduction till Full & Final of employee even his/her salary goes to 5 lac or more per month, but restrict to Rs 780/- employer contribution.
I fully agreed with Ms/Mrs Upasana Madam.

The reply which has been given by the members already can be summed up as under:
1)You can not stop P.F contribution in respect of all those employees whose pay/wages (Basic +DA +retaining allowance if any) Rs.6500/-p.m and below.
2)You cannot stop P.F contribution of all those employees who are already memebers of the P.F Scheme even though their wages exceed Rs.6500/-p.m.However you can restrict employer's contribution to Rs.6500/-p.m even though the employee seeks to contribute on more than Rs.6500/-p.m
3)The employer is obliged to pay ESI contribution for all those employees whose wages re Rs.15000/- and below.
Bothe P.F Act nad ESI Act prescribe penalities for breach of obligations of the emplyer under the respective Acts.
