This is in reference to a fresher who has joined our company. We are deducting 10% TDS from her monthly salary, which is a small amount. Can anyone let me know which form they need to fill and file with the company so that they will be given the promised amount without TDS deduction?

Form 24Q for Salaries, Form 26Q for Non-Salaries, Form 27Q for Non-Resident (TDS deducted under section 195), Form 27EQ for TCS, Form 27A/27B control sheet for electronic TDS/TCS.

TDS for salaries shall not be deducted blindly at 10% of the salary. You should calculate the employee's total wages per annum, consider all the allowances, exemptions, and other deductions. This is where the Salary Structure plays a vital role. Based on the calculations, you should deduct TDS and remit it to the department.

Ans. There is no fixed percentage of TDS in the case of salary. I am enclosing an Excel file so you can calculate TDS accordingly.

Ans. There is a declaration format (provided by the company itself) that you need to fill and submit to the company. Subsequently, the company will deduct TDS.
