Dear Mr Sanjay Gupta,
Those who are in continuous service in the preceding 12 months (should work not less than 240 days) are eligible for 15 days E.L. during the subsequent year. If a person joins in the middle of the Calendar year, he is not eligible for Earn Leaves until completion of 12 months service.
1. Can be utilized three times in a year.
2. Leave should be applied one week in advance.
3. Leave can be encashed for 8 days in a year. However Company pays 15 days wages/salary in lieu of Earn leaves at the time of Pongal subject to availability of 15 days leave. Otherwise balance leave is allowed to encash
4. Intervening holidays/week-offs will not be treated Earn leave.

In addition to the opinion of respected Sharmilaji, wish to add the following. If it is a factory and covers under the Factories Act, 1948, please go through Chapter VIII Section 78 and 79 Annual Leave with wages wherein (Sec.79 subsection(i) ) it was mentioned that 'if an adult, one day for every twenty days of work performed by him during the previous calendar year'.
Also enclosed please find herewith a draft notice and procedure which may help you in formulating leave rules.

Thank you very much for your answer, but I still have a doubt. If an employee is appointed by the company in Oct-12, will he/she be entitled to 3 months of earned leave, meaning 3.9 days of earned leave?
3 x 26 = 78 / 20 = 3.9 days to be carried over to the next calendar year, 2013, for enjoyment.
