I want to know How to terminate the labour contract due to theft case. His employees is caught 2 or 3 times in theft case. Now my co. want to terminate that contract.
So. what is the process to terminate contract immediately.

After investigation process, and if you have enough proof and witnesses then you can terminate the staff immediately.

You want to terminate the Contract/Agreement or the specific Worker through contractor????
if you want to terminate the agreement, according to terms and conditions set out in Agreement, you can do so, after termination of contract the, Employment of Workers through such contractor comes to automatically an end. But before the you must ensure that all the payment/Wages or other benefit should be paid by the contract to these workers, otherwise they can create Industrial Dispute for non payment of wages etc. Before F&F of the Vendors you need to ensure all statutory compliance documents from the vendor in respect of workers worked under this agreement.
in Second case, if you want to terminate the service of that particular worker who involved in theft cases, strictly don't do by your own, he is not your employee but the contractor's employee. Ask contractor to file FIR against the worker, take disciplinary action and after due course of law, contractor need to discharge him from his service. You being a Principle Employer should not comes in picture. Let the contractor do his job.

Contarctor must be taken in to confidence and smoothly be departed as direct discision may provoke an industrial dispute.
Ensure that all terms and conditions in respect of statutory compliances towards contractual employees are fulfilled and followed meticulosly from principal employer end.At the same time the contractor must furnish all documental proofs of compliances being followed meticulously.
Contractual workers are paid their full and final from your end.
Under no circumstances a discision be taken which has adverse effect on other employees and company as a whole,yet the process of termination be smooth and friendly.
