An employee is getting 23500 salary in hand from employer and employer is a sole proprietorship business. Employer pays salary by his personal account or cash. There are total 19 employees in agency which take outsourced web design work from other countries.
Please tell me what will be the procedure if employee wants to file tax return. Employee has insurance policy and study loan and also pays house rent so basically he will not be paying any tax. First 7 months he received 20,000 and later 23,500.
Also if employee wants to leave the company. Can employer give him salary slip as a proof of salary with no PF deduction. Can employer if necessary now do something to be eligible to give form 16.

Employer has to apply for TAN with income tax department for deducting TDS and issuing for Form 16 and 16A. Employer can issue slip without PF deduction as employer does not have PF registration. Employer can issue salary certificate for the relevant year. Employee can file income tax return.

on what grounds employee will file return, means what will be his/her source of income. because he/she does not have form 16 and employer is not registered with pf and tan
