I would like to start up a chocolate manufacturing company with 5 employees and I want to know the company registration procedures like "Registrar of companies", "Shop and Establishment ", Sales tax, etc.
Is there any ceritificate to obtain from food related Govt. departments?
Can I apply directly? will it be easy or should I need to get assistance from auditors?
Someone who knows the entire procedures to set up a company please guide me.

Hi Mr. Ram
If it is Pvt. Ltd/Public Limited company then you should register with ROC. Else if its partnership/Propreitorship then you shall register in Registrar of firms.
Once the commercials begin then you should register with Sales Tax department.
I believe you are using machinery for manufacturing chocolates so you should register under factories act. and not shops & commercial establishents.
If you can manage then you shall do all the formalities directly else you shall approach consultants.

Of course I am planning for proprietorship company. Machineries are not planned so far. Its like a home made chocolates using plastic moulds. I hope in that case, it wont come under Factories act. Right?

Employee strength will be 4 only (If Proprietor not to be considered as staff. otherwise 5 in total). In that case, Is there ESI , PF and PT registrations required?

Ram, If you run the company your own. It's Proprietory so no registration But it's better get SSI Certificate from District Industries Centre like that, so that you can easily approach for loan and benefits. Secondly you have to obtain Food Safety Licence from FSSAI (New Act comes from last year August). You approach local FSSAi Office which was separated from Health department and it's comes under State Government and also Central Government.
That Food Safety Licence, you have got 1, 2,3 year according your wish. For that, you have to produce, Building Plan/Layout of the Processing Unit area, total HP Load, Production per day/per year, like that. If you want clear direction, better you FSSAI Website.

Since you have started manmade (500 sq.ft. area) no need of SSI, I think so. SSI' registration is advicable to your future exppansion also.
In FSSAI Licence,
You have to produce the details in your application as under:
1. Name of the Products and its per day production capacity (proposed)
Based on your production capacity the Dept. Fixed your Licence fee if your turnover comes within Rs. 10 lacs you have to furnish the turnover below Rs. 10 lacs and get licence and then every year your have to renew the same and submit annual return nil return.
If suppose to add new additional products name you have to intimate the same to the concerned officer and get their additions in the Licence.

And then verification of FSSAI. After getting licence from the Department, periodical inspection has to be done by the Food Safety Officer and ascertain your hygenic level frequently.
And he also taken sample from the end-user (i.e., in shops) and send to Central Labs for anylise if contain any adultration in that. If suppose any adultration found in that you ' re in deep trouble and you have to face criminal proceedings lodged by the Department quite long period.
