I have a question on ESIC applicability.
If an employee is registered for ESI & his Gross Salary is Rs 14000 till March.
In April, his salary is increased to Rs 17000(Gross). Is he eligible to continue his ESIC contribution?

Hi Anan, as you have mentioned that employee salary was increased to 17.000(Gross) from April onwards that employee does not come under the coverage of ESIC act which is 15.000 a month

we cannot go as per their likes and dislikes of the employees and neither not the choice of the employee is validly justified as per the ESIC slab.
if he still insists then keep his gross salary of 14,000 on paper and rest amount you can pay him as cash on voucher basis as miscellaneous expenses
in this way he can enjoy the ESIC benefit as well as the hike of salary given to him

In April / Oct less than 15000 end of the contribution period to be contributed. April/ Oct on wards can not be eligible for ESI. Even though your
employee is willing.

Hi Anan,
The contribution period for ESIC is 1st Oct to 31st Mar in this period his salary was Rs. 14000/-. As per ESIC rule above Rs. 15000/- salary the employee is not eligible for ESIC contribution, so this employee is not eligible for contribution since Apr onwards.

we will not see the eployee likes and dislikes int he context of Statutory Applicability.but substitute of ESIC you need to provide some Medical benefit to him & his family members. for that we need to tie up with one insurance company.
