Hi,
I am working with a reputed computer manufacturer's BPO sector in Gurgaon. I have been working with the company for the last 6 months and I am told that I have only 76 hours of leave accumulated in my leave balance. Also I got in touch with the HR and was informed that the company does not follow the norm of Earn Leaves. Is that legitimate ?

Hi Gaurav,
First of all you are working since last 06 months. Is your probation period is over. Every employee should demand for a HR HANDBOOK of that company at the time of Joining. If company is not following the earned leave then there might be other option . If you are on probation or not yet confirmed then no leave is entitled for you.

Hi Gaurav,
You are entitled to the leave based in Gurgaon, either based on the following :
1. Your Company is a factory - follow Factories Act
2. Your Company is a commercial establishment - fllow Shops and Commercial Establishments Act.
If it is a factory, earned leave is applicable @ 20 per annum
If it a Commercial establishment, leave is payable on completion of a quarter @ 15 per annum.
You seem to be eligible since earned leave is not dependant on probation or confirmation.

Dear Friends
In my openion he is not eligible for earned leave because he is working since last 06 months. Earned leave will be calculated for his last year working only.
Hence he is not eligible for earned leave for this year.
