Could anyone tell me if an employee taking a long leave should the weekly offs be included in it or not? For example, if a person is taking a 15-day leave and there are 2 weekly offs in between, should I count those as part of the leave or consider them as weekly offs only? Please guide.

Hello,
Generally, Earned Leave/Sick Leave can be either prefixed or suffixed to any Holiday or Weekly off, and only the number of actual leave availed shall be counted for availing purposes.
However, no leave can be both prefixed and suffixed to a Holiday/Weekly Off. In case any leave is both prefixed and suffixed to a Holiday/Weekly Off, the number of leaves availed shall be counted from the 1st absence (leave) to the last absence, including the Holiday(s)/Week Off(s) for availing purposes.
In your case, if both weekly offs fall in between the leave period of 15 days, then they should be counted. For example, if an employee takes leave from 7 July 2007 to 16 July 2007 and the Weekly Off is Sunday, then the Leave Days (10 days) will include both 8th & 15th July.
Leave rules differ from company to company.
As per the explanation given for Subsection 1 of Section 79 of the Factories Act, 1948:
The leave admissible under this subsection shall be exclusive of all Holidays, whether occurring during or at either end of the period of leave.

Dear Sugang,
There are 3 kinds of leave, i.e., CL, SL, and Earned Leave or PL. In your case, leave was availed for 10 days. However, you did not mention what kind of leave has been taken. If the weekly off falls in between the CL and SL, then it will be counted as CL or SL only. But in Earned Leave, the weekly off will not be counted. If the weekly off falls on the 8th and 15th from the 7th to the 16th, we have to give offs on those days only; leave should not be reduced.
Anyhow, leave rules differ from company to company.

It should be considered as leave days when you will not come back to work or the country you are working in. You can take a day off and then continue your leave. Alternatively, you have another choice: you can divide your leave. For example, if Sunday is an off day, you can travel starting from Sunday and apply for leave effective from Monday to the following Friday. You can then resume work on the next Monday. This way, it will only deduct 5 working days. However, if you take leave for 2 weeks, it will consider the days off, meaning it will include the days off.

Please help me with a conflict regarding an employee who is on continuous earned leave. If the weekly off or holiday falls within this earned leave period, will the weekly off or holidays be counted for calculating the salary/wages?

Regarding the query about Weekly Off:
Ex: The employee took leave for 2 days in a week, like on Monday and Tuesday. From Wednesday to Saturday, he worked. The question is whether he is eligible for a weekly off or not.
Thank you.
