Dear Seniors,
If the employee joins on 31st July / December in that case the person would get wage suppose 250 Rs. per day.
As per The Bombay Labour Welfare Fund Act, 1953 there are 2 slabs
1) Upto 3000 Employee Contribution - 6 Rs & Employer Rs. 18
2) Above 3000 Employee Contribution - 12 Rs & Employer Rs. 36.
The above case per month wages of the employee would definately more than Rs.3000.00
So in the instant case the contribution of an employee is Rs. 06.00 or Rs. 12.00
My question is if the casual / Contract worker only 01 day & his chances of returning back are zero the why employer should bear Excess - Rs.18 per such all employees.
Because to workers we are not paying per month wages but per day wages so in the instant case his would be around Rs. 300 including all benefits.

Dear Prashant,
one thing make clear that welfare fund is not on the earned salary. The slabs are based on monthly standard salary. So you should make compliance.
Second thing in case of contract worker you need not to pay the labour welfare fund, but it is your duty as principle employer to monitor the compliance done by the contractor and if contractor dose not make compliance the you have to make the compliance on behalf of contractor.

But...
My query is if the wage for worker is around 250 Rs. only then I think as an employer I should pay only Rs. 18.00
But the labour welfare board is insisting on Rs. 36.00.
Can you please clarify the my doubt?

Dear Prashant, Wages for the month goes to 250*30=7500, so it comes into 2nd slab of LWF contribution so you have to pay Rs. 36.00. Regards, Sanjay Mulay
