Dear Colleague,
The format of FORM- L is an intimation to the employee that his gratuity is arrived and it is ready for payment as well he can collect it on specified date from the Office etc.
Simple guideline is given in the below format.
Always pay the Gratuity by Account Payee Cheque to the employee and get his acknowledgement for file. Get acknowledgement in the Form L also from the employee
The Copy of the Form L can be sent to the Controlling Authority under The Payment of Gratuity Act 1965 and keep acknowledgement in the records of establishment.
In case if the employee is expired before receiving his/ her gratuity for any reason then the same Form L to be served / sent to the Nominee as assigned by the deceased employee. Then check the authenticity and then settle the Gratuity.
If no nomination exist, the get copy of Legal Heir and if more than one Legal Heir, it is better to deposit the gratuity before the Controlling Authority under The Payment of Gratuity Act 1965 who will hear Management and the Legal Heirs and share the appropriate share to the Legal Heirs.
