If the establishment area is covered under ESI then WC cannot substitute ESI. In the absence of ESI WC will prevail.

Dear All,
If my registered office is covered under the ESI Act, and if I open branches outside and inside states in India and employ less than 10 employees, then ESI is applicable as in my other plants.
Please reply.

Dear Sorbani,
If your organization is covered under the ESIC act, you have to follow certain points:
Employees drawing a gross monthly salary up to Rs. 15,000 are covered under ESIC and have to deduct the ESIC from the employee's salary, i.e., 1.75% from the employee's salary and 4.75% from the employer's salary. You should file the challan in (4 copies) every month at the sanctioned SBI branch and also file the half-yearly return in the following manner:
- April to September: by 11th November (40 days from the half-yearly closing date)
- October to March: by 11th May (40 days from the half-yearly closing date)

Hi,
Please clarify the following: Our contractor at our warehouse located in the state of Orissa has informed that the area where our warehouse is located is not a notified area as per the ESI Act, and hence he has opted for Workmen's Compensation insurance.
My organization, located in Andhra Pradesh, is covered under the ESI Act. In view of this, is it mandatory that our warehouse contractor has to opt for ESI even though the warehouse locality/area is not notified?

Dear Mamta,
Thank you for all the information. I would like to know more about the procedure of filing challan and the process of filing half-yearly return. Also, if I am not mistaken, the entire process now has software, making it less tedious. However, I would appreciate understanding the entire process.
Please suggest.
