Understanding Notice Period Discrepancies in Employment Termination - CiteHR

If Mr. A worked in a company (Private bank) for 1-1/2 years, his appointment letter states, "If you leave or discontinue your service in the bank without giving notice of 3 months (continuous service without leave)," you will have to pay 3 months' Pay & Allowance, in lieu of the notice period. However, it states nothing about the employer's notice period in case of termination. Mr. A was terminated, given a salary of 1 month in lieu of notice. Is it just? Also, in this 1-month notice, they have not paid the HRA amount.

Notice Periods: Employer and Employee Equality

Notice periods should be equal for both the employer and the employee, and they are intended for mutual benefit. Different notice periods may not have legal sanction and can be contested unless specifically mentioned in the appointment letter.
