Hi,
I work for a Guragon company. I've made to resign I was forced to transfer and work for a payment less than the current. Now i've put down my paper. After a long followup and calling them many times they finally done my F&F and now they are not giving me the reliving letter. They are also not responding for my mail and not processing my PF. As per my employer my PF no has not come but from past 1 year they are deducting my PF. Also the financial year 2010 has been over so they must have submitted all the PF. But they are not picking my phone not responding the mail.
Please advise what to do.

For getting your PF you may take the help of Enforcement Officer or the Asst. PF Commissioner of the Employees Provident Fund Organisation of the area. You can make a representation and they will intervene. Once the establishment is given a code number, it will be the establishment which will allot account numbers to the employees. Therefore, the contention of the employer that the number is still to get is baseless.
It is always difficult to get relieving certificate from such adamant employers without the help of any outside intermediary. Therefore, you may try to take the assistance of some known person and speak to the HR/ employer and collect relieving order. In such case, it would be practical if you first get the relieving letter and then only proceed with your PF case.

Hi Dude,
First you organized your all details that you got from your company.
Like :- 1.Salary Sheet,
2. Bank statement
3. Offer letter
4. Appointment Letter
5. Increment letter (If you received)
Hi dear as per EPF condition on Account number, After three months of contribution on EPF, The EPF department issue Account number and after one Accounting year, they issue Pass book.
No need to scared, you go to that particular company and meet with HR department and show your document and also warn them that if they would not give account number, i will go to PF Commissioner office,
before going to company, send this above document xerox copy by register post with cover letter showing your all issued and ask for the same to that particular comapny.

Hi there,
I would ask legal counseling and then approach the company giving them the chance to cooperate before going to court - in my experience they will agree to your terms when they see that you are serious about going to court.

Dear Madhu Sir and Vikas Sir,
Thanks for your kind advise. But irony of the fact is VP HR itself doing all these things and she has directed her team also and they are also supporting her. I have an increment letter also. Problem is I am in Pune due to some family problem and cannot come there. Moreover they've also not maintained my leave record properly. The leave record has been filled with pencils and all with no justification. Also each time they have send the F&F sheet my date of joining was different. I've all the proof to prove the same.
Please advise.

These are all due to bad HR in your office. It is high time that your establishment will face a very bad time provided your HR does not wake up and become proactive. In fact, we are helpless when the HR is rude. Therefore, try to take the help of some persons whose words can not be violated and do the rest as advised by me and others.

vikash1017 is spot on.
All you need is a register letter sent to the HR. Most HR will ensure a response. I would suggest 1 small change.
You need not send them other documents with the letter.
Please verify that the documents issued are duly signed by the relevant people (offer and increment letter by HR, resignation notice by your immediate boss etc.) before you send this letter.

Hello,

A sincere advice from my side : kindly mention the name of the company (for the benefit of all our HR Colleagues) and the name of the HR Personnel aswell so that we all know who's the one who's spoiling the image of HR. Afterall one of the purpose of this site is to discuss, take help and improvise ways to develop and improve HR.

Coming back to your issue, Kindly check, if somebody else who would have joined your company after your joining, has been allotted P.F. number. If yes, then my dear, your company has been fooling you. Logde a complaint immediately through a lawer.
Do note your establishment code, carry your {employment letter, monthly salary slips with (bank statements for the period for which your company would have paid you the salary) and all other official documents issued to you by your company} when you go to file the complaint.
If leave records have not been maintained properly, it's the company's problem, and you need not have to worry till the time you have all the proofs for the salary that you would have been paid by the company.

As rightly suggested by one of the experts, through Reg. A.D., do send your complaint letter with the self-attested photocopies of all the documents received by you from the company of yours including the different F&F letters and ask for explanations to the differences.
Politely, request them to process your p.f. immediately and tell them about your intention to approach the legal authorities in case they cause any further delay.

If you do not get a reply in 15 days, send a second letter in the same manner. This will serve as proof to the fact that you have given sufficient time to your employer and that you have gone legal, only after exhausting all the other resources available to you.

kindly DO NOT post the name of the organisation here as it can very well have legal ramifications, with the company finding a reason to delay F & F.
It is best in such cases to keep communication professional from your end and between yourself and the organisation.
