I wanted ask, whether there exists any policy as per which we are liable to break bond if company fails to pay salary on time. Every time we receive our salaries after 17th or 18th of the month. Like our March salary would be credited to our account after 18th or 19th(minimum). So kindly reply can I break bond, since I am already paid and being exploited by my organization.

The bond as it is is illegal and therefore, breaking the bond does not arise. However, if you have entered into a contract with the company and at the same time the company is deviating from the promises that can be cited as a valid reasons for your leaving or terminating the contract of employment. There can not be any clause in the bond that the company can pay salary at its will or the employee should not question if there occurs delay in disbursement of salary. If there is any such clause, that is not valid because any contract in contravention of Law is void. In other words, the law (Payment of Wages Act) provides that every employee should be paid salary within seven days of close of wage period. If the employer makes an agreement with employee to the effect that salary will be paid only after 18 days, that agreement will not be maintainable as it is against the Payment of Wages Act or any other rules made thereunder.

It is always desirable to leave an establishment which delays payment of salary to its employees.

Thanks v much for replying. No it was not mentioned earlier that our salaries would be delayed. So in short, what would you suggest me, m I liable to break bond, I am having a very good offer in my hands, my only concern is bond. Please reply what should I do.

Forget about the bond, you may accept the offer and leave the present firm at the earliest. Regards, Madhu.T.K
