Dear Seniors,
One of my employee slipped in our office Premisis and suffered some serious injuries. He was on leave for six days as doctor recommended him bedrest.
My query is that will this be paid leave? Is there a policy for the same?

It will be regarded as paid leave. If covered by ESI, you can treat as accident while on duty and if so, payment will be made by the ESI Corporation. Send accident report to ESIC. Regards, Madhu.T.K

Dear divya
Is your factory covered in ESIC. than show it a accident. than ESI will pay all the expenses and other benifits . just simple way fill a accident form and send it to ESIC. if you factory is not in Notification Area . than i think you should have taken a Workmen compansation policy and GPA (Group Personnel Accident )policy. than you can claim as per policy norms.

you have mentioned that employee slipped and suffered serious injuries, but you have not clarified that the employees is covered in ESIC ( salary is upto Rs. 15,000/-) or not covered in ESIC ( salary is more than Rs. 15,000).
- if he is covered in ESIC than ESIC will make the payment of the salary if ESIC prescribed for leave
- if he is not covered in in ESIC than it is the decision of Management whether they want to give him paid leave or not or want to adjust his leave ( viz Sick Leave or Privilege leave), in real situation these days will be adjusted from SL or insufficient than from PL.

Obviously, he is entitled for paid leave if he is out of ESI.
if he is IP then doesn't matter, u have to submit accident form to concern branch office and left the problem for ESIC. It is mandatory for u to submit accident form in r/o of injured employee who is covered under the ESI Act when accident occurred in the premises and suppose to be in the course of and in connection with an employment. In case urs is factory then factory inspector should be intimated about the accident.
