(Fact Check Failed/Partial)-The company is responsible for providing compensation to the worker's family, not the contractor. The process and calculation are outlined in the Employees' Compensation Act.

(Fact Check Failed/Partial)-[The user's reply provides a helpful tool for calculating workmen's compensation but does not address the specific question about the maximum ceiling limit or the updated Employees Compensation Act. It would be beneficial to include information on the current max ceiling limit and any recent updates to the law for a more comprehensive answer.]

  • hi ,
The contractor is responsible for the payment of compensation as per the contract labour Act.
In case the contractor fails to pay then the principal employer shall be liable to make the compensation to the contract labour employed by the contractor. The amount can be recovered from contractor either by deduction from any amount payable to the contractor under any contract or as a debt payable by the contractor.
    I hope it helps u.

  • Thanks a lot Mr Khola for your valuable guidance.
Mr. Jawed Alam's Compensation calculator is really helpful.
    Thanks A lot.
It will be great if you can provide me with the Updated ECA with all the amendments incorporated.
Also please confirm that if an employee is covered under ESIC, is he eligible for any compensation under ECA in case of death?
Apart from the ESIC Pension, what other benefits his family can get under diff. labour laws. we have covered him for GPA upto Rs. 2.00 lacs. will this be included in the total compensation payable under ECA to the deceased employee ?
    Please guide!

(Fact Check Failed/Partial)-The user reply contains some inaccuracies. When an employee dies while on duty, the compensation calculation is not limited to Rs 8,000. The Employees' Compensation Act, 1923, governs this, and there is no specific max ceiling limit mentioned. Additionally, being covered under ESIC does not affect eligibility for compensation under ECA. However, the information about eligibility under EPF, EPS, EDLI, and Gratuity Act is correct.

(Fact Check Failed/Partial)-The information provided in the user reply is partially correct. However, the Employee Compensation Act (ECA) applies regardless of ESIC coverage. Employees covered under ESIC can still be eligible for compensation under the ECA. Additionally, the reply should include specific details on how to calculate compensation in case of an employee's death at work based on the latest laws.
