Dear sirs,
We have applied for Labour licence on 15th Oct 2010 and receive it on dtd 25th Oct 2010.
However, I have engaged the worker since 1st Oct 2010, But I have submitted PF and Prepared wages sheet for this work since 1st oct 2010.
Now My question is that for the Labour Department, I will have to show the wage sheet and other resister after getting the licence date (i.e. 25th Oct 2010) or It will ok from 1st Oct 2010.
Please reply urgently, I am waiting for your response.
Thanks in Advance.

Dear sir,
Please elaborate your view on this topic.
can i prepare it from 1st Oct 2010, despite of receiving labour licence on 25 Oct.
If they ask why you engaged your worker without receiving labour licence?????

The basic rule of labour department is that first let the contract starts and then the license will be issued. This is because lot many times it has been found by labour deptt. that license issued first, is not in use and unnecessarily the labour deptt has to maintain the records of the contractor. Hence you are not at all wrong. Don't separate the wage register.

Hi,
You had applied for the licencse that means it is applicable for you. So maintain all relavent documents from the date of applying. As rightly mention by Mr.Malik Labour department is not so active to check all the records but from your side you need to maintain records as per the law,as any time they may ask for it.
Hope this will help you.

Dear Mr.G.K.Sharma,
Nothing wrong for showing the wage register or wage sheet from 1st oct 2010 onwards.
If you showing the wage sheet from 25th oct in future you have face other legal aspects like accounting/service tax and TDS etc.
Hope the best

Dear Mr Sharma,
You can only apply for a labour license after you have been awarded a contract. It is required only if you employ 20 or more contract labour at any single location. You can commence work and apply for the license within a reasonable period of time. You have done very well to have obtained the license within 25 days from commencement. You are absolutely on the right side of labour law.
Since you commenced work on 01 October you need to maintain your account books and details wef the same date. Agreed the labour department may not check all details but the fact remains that they can! After all, these are measures for the welfare of the labour class. Also by doing so you would be looking after your personnel, keeping your books immaculately and will continue to remain on the right side of the labour department.
To your success!
