Hi all, I am working with software company since 3years. but recently company started changing few rules of employees. those are 1.Notice period. 2.Salary calculation. Thanks kumar

Notice period is generally mentioned in the Offer Letter or Appointment Letter. So, whenever there is an offer and acceptance, meaning a contract, it will be governed by the Indian Contract Act, 1872. When your company offered you the job, the notice period was specified in the offer letter under a particular clause. Therefore, if your employer attempts to alter the notice period as stated in the offer letter, it would be considered a violation of the contract. You have the option to seek legal assistance and file a suit against the company. However, it is essential to note that if your company is changing the notice period for new employees, they have the right to do so.

From the company's perspective, if you wish to change the notice period, you must provide a new contract to all employees with the revised notice period and terminate the previous contracts accordingly.

Dear kumar regarding salary calculation the matter is not clear to me...what type of changes the company is doing in salary calculation please clarify first... Jawed Alam

They are going to calculate the salary based on working days, not the number of days in the month. For example:
- Number of days: 30
- Number of working days: 24

Previously, salary calculation:
30 * amount = salary

New salary calculation:
24 * amount = salary

Dear apm16,

Once the notice period has been mentioned in the appointment letter as 30 days, it cannot be changed without offering you the new notice period formally. Until you accept the same during your service period in that company.
