Dear sir
I was on leave on 25th and 26th feb 2010 and my BM when send attendance for salary relase in a salary format through mail and kept my superior in CC. my superior without informing the my BM changed my leave into absent. Finally when I approach to higher authorties they also taken side of my superior and ignor the fact. My leave was approved by BM
In the month of appril I mail for sick leave as I was sick but my superior out rightly reject the same but as doctor told me u need rest bez I have pain in my testes . thus he make absconding case against me and keep the HO in dark and company terminated me as i shown all medical document to the HR department but give only one answear u r terminated now we cannot do any thing.. Can u suggest me what should I do now.

Dear Zaffar,
I think the company is not in need of you.
However, that does not ipso facto give them a right to terminate you like this.
can you send me a list of dates with good details.
did you sent any mail or letter to the company recording the entire fact?
Kindly send the details so that we may help you.

I have upload all the document pls check. there is leave approved by BM on (25th and 26th feb2010) and attendance register photo copy where leave is marked and BM have attested the attendance before sending the attendance in a attendence format for salary release. salary cycle start form 19th - 18th of every month.



also medical documents r attach.

when i came back from medical check up after 25 days and join back the office my state head told me you rejoin the company bez ur leave was not section by ur superior but three absconding letter was issued to me and sent on my home address as i was out of home for last 25 days.

i refused to rejoin the company bez i was not absconding even my BM was very well aware about the fact bcz verbally i told him and also handover leave to him but i don’t know why he not section the same. finally Branch HR Sent my case for termination and no termination letter was issued to me and on my F&F Statement it was mention that i have submit the resignation on 28th of may 2010.



also they generated two F&F Statement of mine in fist they mention my last day of work 31st march 2009 and harass me to pay 6796 rupees to company neither legal action will be taken against u but when I told them that I was in office till 10th April 2010 before leaving on leave then they generated my 2nd F&F statement. This is an important point to mention here that when the generated my first EOD letter in which my last working 31st march 2009 they said that company cannot take u back becz ur EOD letter is generated but when the found it is wrong generated then how they generated the 2nd EOD letter, They kept me in dark. These all question was ask to HR department but nothing was done better for me.

Finally HO said me it is BHR who present ur case for termination and Proper Absconding process has been followed in your case and Termination done as per company policy.

The below is the wording of one of the pune HR department person who wrote me

DearZaffar,

Please give me time till today EOD and I

will revert to you on this case. I have been following up with our Legal

team because once an employee is terminated, we cannot reinstate/reactivate

the E code. Also, in below case, it was your State HR - Mr Mukesh Pratap

Singh who has taken the lead and highlighted the case to us. He is also

trying his level best to resolve the below case.

Thus beuz State HR - Mr Mukesh Pratap Singh was directly involve in my case and he blindly presented my case for termination so to save him they ignored my all requests

So it is request to you goodself please check the documents and suggest me what should I do now.

Zaffar,
pls provide all the above details in a list of date format.
put the oldest date first and corresponding events like this:
24.3.2009: I put an application for leave to ........... 2 days from . to .........
26.4.2009: sanctioned the leave
27.5.2009: intimated me about the sanctioned leaves
etc.
pls forward the same urgently so that a strategy may be fixed.

Dear Sir

On 24.02.2010 I applied for casual leave for two days w.e.f 25th Feb

to 26th Feb which sanction by BM

27.02.2010 It was holiday in Doda Satellite Branch due to Eid Milad

28.02.2010 it was Sunday

31.03.2010 I received salary slip in which only 28 days were count (salary cycle start from 19th-18th every month.)

My superior Mr Dheeraj Gupta (Assistant Branch Supervisor) was informed through mail and telephone by me and BM also about the leave. But still he changed the format in which attendance was send to him by BM and marked me 3 absents and 2 leave (actually he tempered the format).Nobody taken any action against him. Even he was failed to show the days which he marked absent.

Till 31.03.2010 BM of the Branch was well aware about my sickness and he was verbally told that I need leave.

From 01/04/2010 BM was in jammu and I and office boy was present in office.

On 10.04.2010 sick leave was send to Mr Dheeraj Gupta (Assistant Branch

Supervisor) him through mail with attach hospital doctor

check slip but he out rightly rejected the same and not

given any reason. Same day BM was informed because he

was also in CC and state Head was also kept in CC.

On 07.05.2010 I came back after medical checkup and join the office but

my state head Mr Pradeep Ohri told me for rejoin

On 01/05/2010 company transferred Mr Sushant Dubey on my place at

Branch Doda without issuing me any transfer letter but

without giving me any intimation about the transfer and

neither transfer letter nor termination letter was issued

against me till date but in company system I am resignd ,

terminated.

On 11.05.2010 I show my medical document to BM in doda office and he

informed to HR and my superior that he was sick but

company terminate me on 21.05.2010 because State

HR Mr Mukesh Partab Singh mislead the HO in my case

and my termination was taken. and showing my fake

submission of resignation in F&F statement as on

28th of May 2010.

When I came back to join office after 25 days I saw the attendance register that BM has marked his present as P from 1st of April 2010 till 30th of April 2010 as he was doing initial sign last two years and from 1st of May 2010 he again start doing initial . it means sir he was absent whole month of April 2010 and somebody else marked his attendance but HR department never check this type of serious issue that why BM of the Branch done this mistake. If he is doing initial last two years how he forget doing same in the month of April. And again BM remembered that he is doing initial last to years he start doing signatures. Nobody asking him where he was last one month , nobody is issuing him absconding letter , no need of sending leave application but if we apply for leave they reject it out rightly and HR department immediately take action against us.

DEAR SIR
in oct 2010 i was terminated by force by company and i submited case in labour cour ...now after apx three year i won the same becz the company not attended the court in these three year......case is now xparty....court send the notice many time to Co. .........for appeal...but they not came to attend....finaly one month before the court send the finall notice them for appeal..but they ignore the same.....now court will send them the notice to pay the three year salary to me.............will company pay or not...as labour court decession is in my favour..
