If i resign in mid of January 2011 i.e total working period with company is greater than 4 Yrs ,8 Months , should i be elegible for gratuity.
Also pl note that i have been on medical leave for approx 3 months in these 4 yrs 8 month.
Pl clarify.

i saw the PDF copy of the Madras High court judgement. Thank you for the same.
However the inital paragraph of the judgement is a bit confusion. It says 240 days min then subsequently it says 10 months 18 days after 4 years completion. Is it 4 yrs 8 months or 4 yrs 10 months 18 days for the eligiblity of Gratuity?

Hello sundar, Continuous service of 240 days every year and 5th year, should have crossed 4yrs 8 months and 18 days. Regards, ASK

I have served 4 years and 203 days in 5 working day company. But my company is sticking with 240 days saying 190 days is applicable only for those who work below the ground in a mine.

As per the Gratuity Act 190 days is for those who work below the ground level. As per his statement, it appears that he is not working below ground level nor in mining industry. Also his company works for 5 days in a week. I too require clarification on this issue please.
