How many days of leave is a person legaly entitled to per year.

We do not fall under ESI. My querry is for both the admn.office,which 4 employees and the factory, which has 24 employees under various sections.

Dear Member,
If your unit is covered under the Factories Act then grant EL in accordance with chapter VIII of this Act on annual leave with wages( sec 79). For grant of CL & SL you are to follow the State Industrial Establishment (National & Festival Holidays and Casual & Sick Leaves ) Act. If your Admn. office is separate then adhere to the State Shops Act for grant of CL, SL & EL.

As a general thumbrule, the default holidays under Negotiable Instruments Act would need to be observed along with the national/state holidays. You may also be eligible for Casual/Sick and a few privileged leaves.

Say in a region there is one regional office which is situated at Calcutta and the employees being recruited in Calcutta office are being sent to site locations to work with the client at the client site location. The employees are Quality Engineers.
The question is
a) If the company of Calcutta asks them to follow site holidays since they are site, is it legally correct? The holiday (other than Sunday, EL, CL, SL) at Calcutta office is 17 days in a year but at client's premises or site it is 8 days only.
Please comment from a legal aspect.

Leaves for industry/company/factory/shop&establishments should follow legislation as per type of organisation as stated with your leave policy designed in HR manual.Obviously one should follow factory rules of state/Shops and establishment act in which Annual leaves with wages policy is classified into chapter please go through it.
