I have almost years of experience in the software industry in 3 companies. In my current company, I resigned 40 days ago by requesting my release. However, they have not sent any acceptance mail. I have sent numerous emails to confirm the date, but there has been no response.
One day before my release date, the company asked me to provide proof of my experience from my first company. I presented all the documents I have with the company. However, they are alleging that the experience from the first company is false and fake. This first company closed almost 1.6 years ago, and there is no current means of communication with them.
I have received my salary in cash, without any tax deductions or PF contributions. My current company is now asking me to write a letter accepting that my previous experience is fake, after which they have planned to provide an unclean release.
Could you advise if there are any rules in place to obtain a proper release? If I were to pursue legal action, how should I proceed?

It is quite strange that a company is asking for an experience certificate after resignation. This shows their malafide intention. I feel that your company is trying to harass you by giving an unclean release. For this, please consult a proper lawyer and write to the company your case in detail.

I just met my lawyer, and they are also saying that we can go legally. But it is time-consuming. I need to join a new company on June 2nd. I heard recently some new rules have been introduced, like conducting any necessary verifications before joining. Do not take any actions after joining. Is this correct?
I contacted my immediate HR, but he mentioned that I require clearance from the background team; otherwise, I cannot proceed with the release process. I sent an email yesterday to all my supervisors and their supervisors, but no one has responded.
Could you please provide me with your supporting comments on my employment? This would be very helpful.

I am also in the same position. I have completed 5 years in a reputed IT company. After resigning (and completing my notice period), they are asking for background clearance. I am still facing that issue.

Is it clear now? Did you get everything properly? If not, you can file a case with the Human Rights Commission. It will be very helpful, and they can be in favor of your side.
You don't have the direct right to go to the labor court or high court.
