Hi All, A few months back my friend joined a company in which she was in a probation period of 6 months. At the time of interview certain commitments were made; 1. salary as 10k fixed 2. Cab(pick and drop) 3. Meals 4. 1 CL Also serve a NP of 15 days before leaving the company. After 12 days of joining the company has give a letter to him stating that there will be : 1. 30% salary deduction 2. No Casual Leave 3. No Cab 4. No meals certain other verbal commitments were also done. The company cheated her as appointment letter was given on 5th Jan and deduction letter was of 1 Jan of the same month. No commitment were fulfilled....:mad:. A kind of mental harassment was there. At last when she resigned without serving the Notice peroid, now the HR is nt giving the resignation acceptance nor the salary of 15 days(not served the NP). will she can get here salary of 15 days working with the company?:confused:....

Dear Shivani, I understant the problem ur friend is facing. was these commitments were included in offer letter? see, these dayz people know how to make fools. sorry but it has happen. u can't do anything in this regard. If u have any testimonial pertaining to this,u can contest against the compay in labour court under the payment of wages act. Regards Vipin:)

As suggested by Vipin, you can lodge a complaint. But I prefer before moving to Court, let it be conciliated before the Labour Officer. But before doing so, please remember that you may fail to get a better reference from the employer for your future career. Regards, Madhu.T.K

Hi, I'm not sure if ur case will hold strong in the court. One should always make sure that all the committments are put down in black and white. Without proper proof nothing can be done. Also the company will be able to proove that ur frnd did not serve the agreed notice period and hence they have retained the pay. The best solution would be to leave at this point. Opting for a court case would severly affect your frnd's career.

as you stated that at the time of joining they give joinning letter in that all the matter what ever you mentioned it will appear and after joinning if any one not applied and also as per the labour rule the person is eligible for one Casual leave is allowed and the remaining is comes under perks and it is differ also and also it depends on the company policy

it is true that your friend can go to court and finally after very long legal procedures,she/he may get 15 days salary and some nominal compensation. But I would suggest not to run after this but kick start job search and find another job in a company with good governance best of luck

Mr. Madhu By my experience of attending conciliatory meeting on various occasions in various places, let me tell u that conciliation will not be of much help where the employee is not even 1 month of service.. in one of my previous postings, i had suggested what u had said now. we, HR employees have to keep future referrals in mind. No other company will easily or willing employee one who has approached conciliation for whatever the reasons is, that too, a HR person. To be practical, this girl either accepts what the management has offered ( this may not be cheating but possibly some recessionary policy step taken in between the interview and her joining) or honoroubly exits to wait for a well paying job in these days.
