Can an employer force his employee to go on leave (with or without pay) or would such an action amount to unfair labour practice under the Industrial Disputes Act? It would be helpful if relevant sections of the concerned legislation our quoted with any (available) judicial precedents. Thanks Prashant

Compelling an employee to take leave is unfair practice though there is no explicit provision in the fifth schedule to the Industrial Disputes Act. Regards, Madhu.T.K

Lay off is always a temporary arrangement. Any lay off following the provisions of the Industrial Disputes Act is legal. Regards, Madhu.T.K
