For unauthorised leave/ absence deduction shall be made from the salary. There is no legal complication in it. Section 7 (2) (b) of the Payment of Wages Act, 1936, permits deduction from wages due to absence from duty. Each company may have its own leave policy and regarding leave without pay, normal practice is that LOP is granted in extraordinary circumstances when the employee has no other leave to his credit. However, continuous leave without pay for more than a week shall be viewed seriously. Regards, Madhu.T.K
