Dear seniors. Please brief me about below
What are zones 1, 2 & 3? What is the base to classify them (criteria)? Is the applicability of ESIC to particular area is depend upon these zones & how? What is exact difference between ESIC & WC policy? I hope you will help me out.

Mahesh,
I think you are talking about zone with reference to Minimum Wages Act. Zone are not concerned with ESI coverage. ESI publishes its coverage area separately. Area where ESi will not be applicable will be covered under WC Act ( Now renamed as EC Act )

But still please provide me information about criteria of zones. And another thing is that on what basis ESIC decides that particular area will cover under ESIC.
Q) In grampanchayat area one company is cover under ESIC and another is not so what is the reason behind it?
Please provide information.

Dear Mahesh
ESIC extends their coverage based upon minimum no of IPs in that area. Once the Scheme is extended to an area no exemption whatsoever to
any company if it falls under the definition of establishment as defined in the ESIC Act

I would add to views of Mr. Prashant B Ingawale(with due regard) on following point:
"Area where ESi will not be applicable will be covered under WC Act ( Now renamed as EC Act )"
W.C. Act is applicable to the area where ESIC is also applicable; but u/s 53 of The ESI Act, there is specific bar that Insured Person (Under ESIC) cannot claim benefits under W.C. Act. Any other person who is not insured but working in ESIC covred area can claim benefits under W.C. Act.

Dear Mahesh,
As already pointed out, ESIC authorities cover the area by their notification. So you can check your area from the Local Office of ESIC. If your location is covered, then you can apply for Regn and proceed further accordingly.
General test may I tell, if your establishment is old one in the covered area, then ESI authorities must have visited you to cover you.
Sometimes area may not be covered but later on added by the authorities and accordingly the Act is implemented which may not be implemented earlier.
Hence, to be sure, please visit ESI office in your area

Dear Mahesh
Pls do inform me about covering of your area after due enquiry as suggested. Pls also note coverage of employees under ESIC is good because it not gives medical aid to family but also insurance to the IP for employment injury. For example, if there is a driver and unfortunately get employment injury, then his family will be able to insurance benefits as well as medical treatment which may be of any cost.
