Dear seniors,
Actually when I joined the company and as per agreement signed the notice period was 45 days but after 7 months of joining , the company changed the period to 90 days and mark the mail to all employees that period is changed for all confirmed employees.
Now pls suggest me (1 year almost completed from the date of joining) whether the company can change notice period retrospectively??
Regards
Sumit

The date cannot be retrospective... but what your information says is that this will be applicable for all confirmed employees, therefore starting the date the mail came, all those who are confirmed till the date the mail was sent, they will have to follow the 90 days notice period.
The confirmation clause is so as, there might be more no of confirmed employees and therefore to let people know who all are covered under this mail, they might have said this is applicable for all confirmed employees. So if you are already an confirmed employee than from the date of the mail the notice period for you will be 90 days.
Hope the confusion is cleared.

Yes it is applicable to you too once you get confirmed. If you are under probation the applicability of Notice Period will differ.

I second the opinion shared in the forum.
1. From a particular date the company has changed the notice period for all confirmed employees - so the employees who are in service of the company is required to serve the new notice period.
2. The employees who are about to be confirmed by default comes under this new rule.
However for your personal understanding, you can approach the Human Resource Dept.
