Being an employer, if we try not to process the pf claim process by not attesting or delaying the withdrawl process, how fair it is? Specially for the ex employees who has not served the notice period.
According to PF act, employer cannot hold the process of pf withdrawl process even if employee has been terminated.
Can employee still claim his pf from pf office without coming to employer, if yes how? if No, is there any legal complications which employee can impose on employer.
what's your point of view, any suggestions.

Yes, if pl claims not authorised by employer then employee can directly send to the concerned RPFC office. For this you can refer instruction for filing up application form (Form 19 & 10C) which you can get along with form 19 & 10C, which is as follows :
If the member is unable to send the application through the employer or duly attested by his for any reason whatsoever by may forwarded the claims duly signed in the presence of any of the following authorised & got attested over his officical seal.
(10 Magistrate (2) A Gazetted Officer (3) Post/sub post master (4) President of the village union (5) President of the village Panchayat (6) M.P. (7) MLA (8) Manager of the Bank in which saving bank account is mainted

If employer is not signing in Pf withdrawal form than the manager of that bank in which employee has his bank account can sign and if employer is not signing the form than person can post the same form to pf office mentioning that the employer is not signing the same and pf form will be done by the pf office itself.
