If the Contractor is not paying the wages, the principal employer has to pay it to the workers of the contractor. Now if he has not paid ESI and PF, then the Principal employer has to register the workers of the contractor under the Principal employer's ESI and PF regsitration and pay the dues. Though salary can be paid directly to the workers, with the online portals for payment of ESI and PF, the concerned employer only can access to the respective portals. Moreover, if the principal employer pays it through the portals of the contractor, the payment will be deemed to be made by the contractor only. Therefore, the principal employer should pay it through his own portal and then get the amounts reimbursed from the contractor.
