My wife has been working with a B pharmacy company in Mumbai for the past 10 years. Her salary is 30,000, and she is not under ESIC. So, can she get the benefits of maternity leave during her first pregnancy? If yes, how can she apply to her company?

She will be entitled to get maternity benefit. She has to send a communication to the officer concerned, her reporting officer or the HR, that she is pregnant and will require leave from the date mentioned therein. The leave is for 26 weeks, and 8 weeks of which shall precede the date of child birth. Therefor, the expected date of delivery is also to be mentioned so that the management can estimate the date on which the leave will start. There are forms prescribed but are meant for mines circus etc, but what is required is to give a notice, and even failure to give notice shall not disentitle a woman to maternity benefits. Therefore, a mail communication would be sufficient.
