Dear All, In my company 07 casual leaves are given for a calendar year and are allowed after completing 240 days. If the employee joins the company on January 1, 2023 and completes 240 days on August 31, 2023, then how much CL can we provide to him for that year.

You may read the leave rule clearly. It MAY contain some other qualifying condition like, "you will be entitled to (casual) leave after one year/ 12 months, provided you have 240 days of working in that one year" Please check and revert.

Your company is providing 7 days CL for the employee serving a calandar year. Therefore employee will get 5 days CL, on completion of 8 months i.e 240 days as per the pro rata calculation.

First and foremost is whether your company is a Factory or one which is Shops and Establishment? If it is a Factory there is no prescription for CL under the Factories Act. Please read Section 79 Annual Leave with Wages. If it's a Shop or Commercial Establishment Chapter V deals with Leave wherein it is prescribed to grant 12 days of CL and 12 days of SL is to be granted for the first 12 months and subsequently the same for successive 12 months period thereafter.

If the employee has joined on 1st January, CL is based on calendar year and the employee is still in service, then the employee is eligible to the full 7 days. As the leave rules have a clause that CL cannot be availed before completing 240 days of work which he has done by 31st August 23, he can avail the 7 days CL anytime between 1st Oct 23 and 31 Dec 23.
