Is it mandatory to avail esi benefit under the new wage limit of 21000 for our old members. If they don't want to get this. Is it possible.?
As per my knowledge it is for new members . And if old want to avail this benefit then they can get it.
Am I right or wrong? Make Me clear please. Your suggestions are precious and will in my professional life.

Dear member, social security laws are mandatory, compulsory in nature and not optional. As and when there is final amendment to the enhancement of wage ceiling, the compliance is required to be made from the date of enforcement of said amendment.

The Gazette notification is yet to be released. Once it is released the same is applicable for all the employees (It includes existing employees & new employees). No one can avail exemption from ESI benefits if he/she is earning 21000/- or less

Draft notification was published on October 6 by which Government invited objections/suggestions within one month. Medical benefit under the Act is given by State Health departments through separate wing called ESI Scheme. The Scheme run dispensaries and hospitals. In these dispensaries and hospitals services rendered is generally poor. Insured persons prefer to go to private health care providers paying money rather than going to ESI. As per ESI Corporation data as of December 2015, 51% of sanctioned posts of Medical experts and 29% of sanctioned posts of Medical officers remained vacant. Our concern is, how are they going to provide service to the additional 50 lakh workers and their families.

Yes, Notification not received yet. may be it will be effective from November 16. also we are looking for changes in Emmloyee/Employers contribution may be reduced by ESIC. Regards Dwarika P Nautiyal

In our earlier gazette notifications in enhancement of wages limit under ESIC legislation is prospective not retrospective and hence any gazette not published before 30.09.2016, can be treated as not implemented and you can continue to recover ESIC Contribution on Rs.15K only for next six months.

People should understand that ESI is not only useful to get medical treatment in ESI Dispensaries and Hospitals. It can be used to avail medical reimbursement for the treatment done in Private Hospitals and also Cashless Super specialty Treatment in private hospital. It is applicable for entire family. The major advantage of ESI comparing with other private insurances is "Leave Wages".
The employer are exempted from Maternity Benefit Act and Employee Compensation Act for the employees covered under ESI Act.
So, for the employee who are taking Maternity Leave, she can get the salary from ESI. Employer will not pay the salary for those period.
Also, if an employee met with an accident during employment hours (from the time leaving from home in the morning and to the time reaching the home in the evening), all the expenses and leave compensation will be paid by ESI.
The effective way I followed in my company is
1. Educate or conduct bulk training session about the importance of ESI, benefits and comparison of ESI with other private medical insurances. I educated the same to Non ESI employees as knowledge sharing.
2. Assist the employees to get benefits from ESI.
3. Contact ESI to conduct Permanent Card Bio metric Camp in your office. (If the employee strength is more than 50, they will come). Also, they can even conduct session to your employees to explain the benefits of ESI.
4. Try to make their mind that it is only beneficial to them. Showing about the employer contribution won't help to convince them.
After these steps which I have taken, many NON ESI employees asked me that they are willing to come into ESI. Now, this latest news will give them joy. (Of course, there will be some employees who won't like it - as they never use ESI or other medical insurances)
