Dear Senior's
I am working in manufacturing unit recently one of my worker attempted suicide and died.Now i want settle the gratuity amount he has joined on 2009.
He is eligible or not for gratuity if eligible,what are the procedure and what is the calculation.
Please help me...

His nominee shall be paid gratuity ,if you have 10 or more persons employed.If he has not given nomination his legal heirs are to be paid the amount. Varghese Mathew

Dear,
There is gratuity calculation formula (BASIC+DA * 15 * COMPLIED YEARS OF SERVICE / 26)
In case of death you have to find who is the nominee and asked to fill the nominee the FORM J
If no nominee mentioned then ask to legal hire to fill FORM K and submit that form to Controlling Authority of your area for further procedure.

five years continuous service is not applicable in case of death of an employee. Therefore in the stated case gratuity is payable to the nominee of the deceased employee. Further, for calculation etc it is suggested to go through the Gratuity Act thoroughly.
