I am working in a PVT LTD company under shops and establishment ACT, Bangalore. The issue is regarding the late payment of the salary occuring after the recession period. I will brief the procedure, to help you for a suggestion.
1. The attendance will be freezed by 25th of every month.
2. The attendance and salary reports will go for auditing by 28th.
3. The auditing report will be received by the month end or 01st or 02nd of the subsequent month.
4. The final report will be sent to the finance team for payment with in 2 days time.
From here the delay starts. The company had a practice of paying the salary between 07th to 08th of the succeeding month after the salary period. But now most of the times it reach a time after 15th and sometimes on 25th of the succeeding month.
Is there any law against the late payment of the salary? As an HR, how can I educate the company management on the same!! Please suggest all the possible solutions

Dear Faizal Hydrose,
As per the Payment of Wages Act, salary should be paid within 7 days after completion of a month, where the number of employees are below 1000. If the number of employees are 1000 or above it can be upto 10 days. This is applicable to those draw a salary upto Rs. 10,000.

Dear Abbas, Here we have only around 250 Employees. Even though we have employees who are drawing salary below Rs.10,000/- the salary band will go above Rs. 10,000/- also.

The protection of law ill be only those draw a salary upto Rs. 10,000. They may approach the laour department. It will be difficult to the employer to dicriminate among employees based on quantum of salary. i.e In practical those salary exceeds Rs. 10,000 may also get salary within 7 days.
