Dear Team,

I request to please suggest into the below matter.

I was working with Public Ltd company since Apr'08, whereas I have given my all efforts, time & dedication to company.

Quickly stepping to the point, In Fiscal Year 13-14, I worked hard & had been appreciated by my manager & has won many awards as the result of my work & dedication.

At the time of appraisal, he has given me the highest rating of DE which is not justified in terms of salary hike & promotion.

In the year of 13-14, I have received number of awards & recognition in my organization.

My colleague who hasn't rec'd single prize and nomination(in the year of 13-14) has lastly got the promotion & best hike in our team, which i feels the wrong judgement made by manager & respective responsible HRs.

He has awarded with good hike & rating of "EE" with single level promotion, which I has considered as my insult between the team.

I was wrongly guided by my manager, he used to give me fake commitments regarding the growth.

On the grounds of dissatisfaction, I chosen to look for the different opportunity in market. I have resigned from my current company on running of notice period which is duly accepted by manager & HR on mail.

Also at the time of my employment, I has acquired the medical loan granted as per company policy which has duly approved by my manager & HRD.

I was asked to submit the declaration, format shared as per company on 100 Rs, stamp paper, which contains the below point

"I agree that any amount due by me to company in respect of the said loan can be adjusted against the salary, bonus, gratuity, provident fund and other dues or benefits payable to me. In case I cease to be an employee of company or if there is an outstanding balance at the time of such ceasing or retirement"

Now as the part of F&F & settling this loan, i request my manager & HR team to settle the outstanding balance of my loan with the balance of PF & other benefits, I am being liable to rec'd from company, as per the policy & declaration provided by them.

The company is denying to do the same & asking to settle the loan first. I found myself unable to do the same as I am running with financial crunch right moment.

I have dropped them the mail regarding this & hasn't rec'd any revert from them. I am not going office since 4 days as I am not doing well.

Today morning, I have received the mail from my manager that he instructed HR to abscond me stating false information that he found many mistakes in my past work.

Now I would request if any experienced HR would please guide me into the same.

Also I have given interview in some company & selected for the same, my joining date is from the end of Sep'14.

To my knowledge it can be adjusted against the Salary, Bonus, Gratuity, but not with Provident Fund (it is designed to reach the hands of the employee only and never an employer can get it)

However as you have served the organization for more than 5 years (believe there is no break in service), ask your HR team to work on the Full and Final Settlement, and see how much amount can be adjusted against the Gratuity. Also what is your company policy on Bonus, is the bonus is included in the Full and Final Settlement as a part of F&F or it is paid on monthly basis? If applicbale please check for the bonus eligibility.

After seeing the entire working you can plan for the balance from either side.

With regards to the Absconding, Please inform the forum what is your stipulated notice period, out of that how many days you have served, did you kept your HR team informed about your sickness, if so orally or by mail? Can you get a medical certificate for your sickness? Also do not worry it is tough to frame an allegation as absconding against an employee.

However try to behave rationally with your employer as they have supported you since 2008.
