Mr. Naik correctly suggested for Applicability for getting ESIC Benefit, and i would like to add more on it.
If there is no any ESIC hospital in a district, ESIC is not applicable to employer for that location where the work is progress on that time each and every employee should be cover in Medical Insurance or group Insurance. and also if there is hospital for employees which is being maintain by the employer on that time ESIC is not applicable also. Like Railway, Mining, AAI and many etc.

Hi frnds, In our organization the ESIC contribution of the both the parties (the employer and the employee) is paid by the employee. Is that legal.... kindly advise because am not aware about it....

Employer can't show the deduction of both contribution in payment slip, I think you have seen the CTC calcution of the employee, because it is the part of CTC. Pl see pay slip if there will be, then it should be illegle.

As per the latest amendment in ESIC Act.
-It covers every employee who is drawing a gross salary of Rs.15000PM. For deriving gross Salary , components to be taken is Basic, HRA,and all other applicable allowance except Washing Allowance.
- ESIC is calculated @ 1.75% from employee and @4.75% from employer
-Annualy local ESIC authorities issues notification on exempted and non exempted area. One has to check in which category his area falls.
Hope the applicability is more or less clear

Any organization having more than 10 employees drawing a gross salary of less than 15,000/- pm have to register under ESI act.
For Branch office:
Separate registration is a must if the branches is outside the city or even outside the state.
If the branch office is within the city, then separate registration is not required. But the amount of ESI i.e 1.75% & 4.75% of all employees should be paid at Head office place itself.
