Hi,
I would like to understand leave encashment process under ESIC.
How employee has to go about availing the benefit of leave encashment under ESIC.
Employee has undergone surgery under ESIC hospital he was absent on duty for more than 30 days .
Does he is eligible to avail leave encashment benefit under ESIC.

I think you are talking about leave benefits under the provisions of ESI when a person is sick. The benefits are given below :-

The section 46 of the Act envisages following six social security benefits :-

(a) Medical Benefit : Full medical care is provided to an Insured person and his family members from the day he enters insurable employment. There is no ceiling on expenditure on the treatment of an Insured Person or his family member. Medical care is also provided to retired and permanently disabled insured persons and their spouses on payment of a token annual premium of Rs.120/- .

(b) Sickness Benefit(SB) : Sickness Benefit in the form of cash compensation at the rate of 70 per cent of wages is payable to insured workers during the periods of certified sickness for a maximum of 91 days in a year. In order to qualify for sickness benefit the insured worker is required to contribute for 78 days in a contribution period of 6 months.

Extended Sickness Benefit(ESB) : SB extendable upto two years in the case of 34 malignant and long-term diseases at an enhanced rate of 80 per cent of wages.

Enhanced Sickness Benefit : Enhanced Sickness Benefit equal to full wage is payable to insured persons undergoing sterilization for 7 days/14 days for male and female workers respectively.

any Insured person (IP) on ESIC leave, ESIC will pay the salary for that period which person who did not attended for job because of illness or surgery.
this is the process as per my experience
after joining hospital the Concerned Doctor will issue leave certificate which will be for weekly basic mostly. IP has to submit all leave certificate copies at employer place for information sake.
in final the doctor will give Form-10 means fitness certificate in which the duration of leave and the Re-joining dates will be mentioned that Form has to get signed & stamped by the employer.
after that, that certificate has to submit at the ESIC Branch office they calculate the salary amount & that amount will dispatch to the IP. (mostly it will be lesser than the take home salary of any IP because it calculate on employer shown Basic salary & also ESIC pays 70 to 90 percentage of that salary)
IP has to rejoin to his services on the said date.
