Legal process entail hiring a lawyer and sending legal notice to ex employee about payment for notice period which he has not served in violation of agreement.
Your offer letter/appointment letter should have specific terms for notice period and consequences of not serving notice period.
First see that all documents and terms are clear at your end, before embarking on legal steps.
You will need to draft letters to ex employee under guidance of advocate only.

1. First of all you should write him a letter for paying the notice period salary along with complete details of full & final settlement specifying the amount of recovery. Give him some time say 10/15 days.
2. Wait for his reply, if reply does not come hand over the matter to some good advocate who handles these matters.
3. The advocate will send him a legal notice for making payment if he still does not pay the case for recovery has to be filed by the advocate in the civil court.
