Dear BS Srivastava,
"Wilful insubordination" is misconduct under the provisions of Industrial Standing Orders Act. However, to investigate that misconduct has taken place, you need to conduct the domestic enquiry and find out the facts. The enquiry officer should investigate the causes of insubordination. If the accused employee is found guilty then management may award punishment which could be "forfeiture of salaries and wages". However, please note that the punishment awarded is proportionate to the misconduct.

Salary cannot be deducted as a punishment for disobedience. However, the principle of 'No work, no pay' could be evoked if the employee has not performed his task. This is no punishment.
