I am working in a private limited company in kolkata. My designation is Asst. Officer. I want to know the earn leave rule of Indian laour law.
Is it 1 earn leave for each 11days of working or 1earn leave for 21days of working? Please inform me on an urgent basis.
I know that it should be 1earn leave for 11days of continous work but my comopany is saying that instead of 11days it will 21 days . Is it right? Is it permissible in Indian labour law?

Dear Sumon, As per factory act, one EL becomes due after the working of 20 days. Mean 15 days EL for a year. regards mukesh

Earn leaves are granted under either The Factorie Act,1947 or the State Shop Act. It is not known under which Act your unit is covered. Wether you are Worker/ employee under these Acts. If you does not fall in this category then you will have to enjoy the E L as per you Co. Rules.

IS THIS COMES UNDER ANY ACT - EITHER FACTORY OR SHOPS AND ESTABLISHMENT ? if SO KINDLY ASIST ME WITH THE CLAUSE.IS THIS THE RIGHT WAY TO CALCULATE THE LEAVE DEDUCTION.
If the employee is working in the adminstartive office of the company does the factory act applies?

Dear Satish,
If you are working in a separate administrative office then you are eligible to have earned leaves in accordance with your applicable state Shops & Establishment Act. Therefore, go through the EL provision in that Act. If your office is attached with the Factory then you are to avail EL as per Factories Act, 1948.
