Hi,
Can any NGO provide skilled/ unskilled contract labours to any organisation?
If an organisation form an NGO and employ labours on contract basis through NGO, is it legally correct?
Pls give your views on this.

can the govt supply contract labour ?
it does...
study Ethical trading initiative guidelines for homeworkers, will give you a better picture of unorganised sector..
Meet people from a couple of organsiations eg Mahila Mandal, SEWA (sole union which is a cooperative) who dwell in the same sphere.
let me update you on a recent ruling too:
a NGO engaged in providing domestic helps was charged and penalised under Consumer Protection Act after one of the domestic hires engaged in a theft.

Let me give a more clear picture to the forum.
A construction company wants to hire contract labours for various site constructions. They have also form one NGO for social cause. They do not want to hire labours through labour cnstractor but want to hire through NGO so that NGO can earn some profit & labour issues can be minimised.
My question is can NGO hire lobours on their role and supply to the construction company as contract labours.
Please give your opinions.

if you initiate n help the workers in forming a cooperative/ forum/ union and outsouce work to that body to prevent exploitation of wqorkers then it is a Capacity building/ poverty allveiation program too n can figure in amongst CSR too.

in the reverse side, the workers on their own too form groups and work can be outsourced to them..

ETI for homeworkers lays stress on such an exercise only.. in garment trade we have plenty of poor/ destitute women enagaged in embroidery work at home.. the work reaches them via the hands of scores of contractors..

so ETI wanst the principla employers to map the entire value chain so that end workers can be identified and their conditions improved.

we encourage workers to come to a common place like a panachayat bhavan at a village and do their work there.

ETI also taks about multi stakeholder initative

for eg we wish to provide medical insurance to unorgansiaed sector..

all players in the value chain incl the end worker pay their share and it is quite small apporx 200/- per annum even cheaper than ESI..

next you can encourage them to form a "Bank/ Micro credit facility" too

The Company has aleady formed a NGO for other social causes. My question is whether said NGO can hire labours on its role & supply them to the construction company as contract labourers.

I am quite doubtful for this case.
How can an NGO supply the contract worker. if you do this then where the service tax will go and what about the TDS which diff as per the category of the contractor.

WHAT DOES NGO MEANS, IS THE PURPOSE OF NGO TO EARN PROFIT, OR IS IT FOR A SOCIAL CAUSES, ANSWER TO THIS QUESTION WILL ANSWER YOUR QUESTION AUTOMATICALLY.
IF ITS A GOVERNMENT AIDED NGO THEN PRIOR PERMISSION FROM THE REGULATORY BODY IS REQUIRED, IF THEY AINT AIDED BY GOVERNMENT THEN ALL THEY HAVE TO DO IS GET THM SELVES REGISTERED PRIOR TO SUPPLING CONTRACT LABOR.
BUT IS THEY ARE AIDED THEN THEY CANT GO FOR PROVIDING CONTRACT LABOUR,BECAUSE THEY ALREADY AIDED BY GOVERNMENT FUNDS

Hi, Thanks for inputs. The NGO is formed for social cause. It is not aided by Government. We can amend the Memorundum and alter the purpose & funding clause. Regards, Sanjay
