Hi. Can anybody help with a Letter format - incase post enquiry, charges levelled against an employee found to be false.

The letter exonerating one from the charges will depend upon the case and charges. The following lines may help you to draft one according to your situation. Please try.

Whereas you were charge sheeted for an offense of misconduct/ offense of theft/ misappropriation/ involving moral turpitude (state the nature of misconduct), vide memo dated .......and whereas an enquiry was conducted finding that your written reply to the show cause notice was found unsatisfactory and whereas you were given opportunities to defend the charges on personal hearings held on....... (dates of enquiries) and whereas the Enquiry officer has submitted the Enquiry Report.

Now this order witnesses the following:

The management representative/ the Presenting Officer has failed to produce documentary evidences in support of the charges levelled against you/ OR The Presenting Officer has failed to prove charges 1,3,4, (charges not proved) (and OR) but has succeeded in establishing your involvement in the incident narrated as charges (2,5,7,...)/And OR Against charge No 6 the Presenting Officer has established your direct involvement.

Therefore, and based on the Enquiry Report, copy of the same is attached herewith for your perusal, the undersigned is exonerating you from all the charges. Having been exonerated, your suspension has been revoked and you are hereby directed to report to duty with immediate effect. Your services shall be regularised and will be paid the amount of salary payable to you for the days you remained on suspension after deducting the subsistence allowance already paid to you.
